This Privacy Policy explains how Foundwell LLC ("Foundwell," "we," "us," or "our") collects, uses, shares, and protects information. It applies to our website at foundwellmarketing.com (the "Site") and to the services we provide to our business clients (the "Services").
By using the Site or our Services, you agree to this Privacy Policy. If you don't agree, please don't use the Site or Services.
1. Two different roles we play
It matters which "hat" we're wearing when we handle information, so we want to be upfront about it:
When you visit our Site or request a free ranking audit, we collect and use your information for our own purposes (for example, to respond to you and follow up). In privacy terms, we're the controller of that information.
When we run review campaigns for a paying client, we handle information about that client's customers — but only on the client's behalf and under their instructions. In privacy terms, our client is the controller of their customers' information, and we act as their service provider (a "processor"). If you're a customer of one of our clients and you have questions about how your information is used, the business you hired is the right first point of contact. See Section 10.
2. Information we collect
A. Information you give us directly (Site visitors and audit requests)
When you contact us or request a free Google ranking audit, we may collect:
Your name and business name
Your phone number
Your email address (if provided)
Your website address (if provided)
Information about your Google Business Profile. To generate the audit, you sign in to and grant us access to review your Google Business Profile, and you provide your name and phone number. We use this solely to analyze your profile and prepare your audit.
We only use your Google account access to review the Google Business Profile data needed to deliver your audit. We don't use it for any unrelated purpose, and we don't share it except as described in Section 5.
B. Information we collect automatically
When you visit the Site, we automatically collect limited technical information through Google Analytics, such as your approximate location, device and browser type, pages viewed, and how you arrived at the Site. This is collected through cookies and similar technologies (see Section 7). We do not use advertising pixels or run ad-targeting trackers on the Site.
C. Information we process for our clients
When a client hires us, we access and process information about their customers so we can request and manage reviews on the client's behalf. Depending on the client, this may include the customer's name, phone number, email address, and service history. We obtain this information in two ways:
By connecting to the client's CRM through a secure API key, and
By uploading a client-provided list of past customers into our review platform (GoHighLevel) for reactivation campaigns.
We process this information only to provide the Services the client hired us for. We do not use a client's customer list for our own marketing, and we don't sell it or share it with other clients. See our Terms & Conditions for the client-side rules that govern this data, including the client's responsibility to have proper consent to contact their own customers.
3. How we use information
We use the information described above to:
Respond to your inquiries and deliver your free ranking audit
Provide, operate, and improve our Services
Send review requests and follow-up reminders on a client's behalf (to that client's customers)
Manage Google Business Profiles and local search visibility for clients
Communicate with you about your account, our Services, or changes to our terms
Maintain the security of the Site and Services
Comply with our legal obligations and enforce our agreements
We do not sell your personal information, and we do not share it for cross-context behavioral advertising.
4. Text messages and email
As part of our Services, we send review requests and reminders to a client's customers by email and by SMS text message through an A2P-registered (application-to-person) phone number, on the client's behalf.
Consent. Our clients are responsible for having the legal right and consent to contact their own customers. See our Terms & Conditions, Section 5.
Opting out of texts. Anyone receiving these texts can reply STOP at any time to stop receiving them, or HELP for help. Message and data rates may apply. Message frequency varies.
Opting out of emails. Every commercial email includes an unsubscribe link, and we honor opt-outs promptly, consistent with the CAN-SPAM Act.
Mobile opt-in data. Phone numbers and mobile opt-in/consent information are used only to deliver the messages described here. We do not sell or share this information with third parties for their own marketing or promotional purposes.
If you no longer wish to receive review-request messages and you're a customer of one of our clients, you can opt out directly (reply STOP or use the email unsubscribe link) or contact the business you hired.
5. How we share information
We don't sell your information. We share it only with the following categories of recipients, and only as needed:
Service providers / platforms who help us run the Services, including GoHighLevel (our website and CRM/review platform), Google (Analytics and Google Business Profile), our A2P/SMS messaging provider, and our white-label Google Business Profile management partner. These providers are permitted to use the information only to perform services for us.
Our clients, with respect to the reporting and results tied to their own campaigns.
Legal and safety reasons — if required by law, subpoena, or legal process, or to protect the rights, property, or safety of Foundwell, our clients, or others.
Business transfers — if Foundwell is involved in a merger, acquisition, or sale of assets, information may be transferred as part of that transaction, subject to this Policy.
6. Cookies and analytics
The Site uses cookies and similar technologies, primarily to run Google Analytics so we can understand how the Site is used and improve it. You can control cookies through your browser settings, and you can opt out of Google Analytics using Google's browser add-on. Blocking cookies may affect how parts of the Site function.
7. How long we keep information
We keep information only as long as we reasonably need it:
Audit and inquiry information — for as long as needed to respond to you and for our ordinary business and recordkeeping purposes, unless you ask us to delete it.
Client customer data — for the duration of our engagement with the client. On termination, we return or delete the client's customer data as described in our Terms & Conditions, except where we're required to retain it by law.
8. How we protect information
We use reasonable administrative, technical, and organizational safeguards designed to protect information, including secure handling of API keys and credentials. No method of transmission or storage is 100% secure, so we can't guarantee absolute security, but we take protection seriously.
9. Your privacy choices and rights
Depending on where you live, you may have rights to access, correct, or delete the personal information we hold about you, or to opt out of certain uses. To exercise any of these, email us at [email protected] and we'll respond consistent with applicable law. We won't discriminate against you for exercising these rights.
10. If you're a customer of one of our clients
If you received a review request from us on behalf of a business you hired, that business controls your information and decides how it's used. To access, correct, or delete your information, please contact that business directly. You can also reply STOP to any text or use the unsubscribe link in any email to stop receiving messages, and you may contact us at the address below and we'll help route your request to the right client.
11. Children's privacy
The Site and Services are intended for business owners and are not directed to children under 13. We don't knowingly collect personal information from children.
12. Links to other sites
The Site may link to third-party websites (for example, Google). We're not responsible for the privacy practices of those sites, and we encourage you to review their policies.
13. Changes to this Policy
We may update this Policy from time to time. When we do, we'll change the "Effective date" above and post the updated version here. Significant changes will be made clear.
